Medd Meets Goliath

Brad Medd of Cameron, Ontario started having his harangue with Revenue Canada about 1991. Brad is a local accountant, and after looking after his clients in relation to Revenue Canada he started to see the injustice of it all. Small business and middle income families were carrying the tax burden of the country. They were the ones held responsible for paying the salaries of all the bureaucrats he kept encountering. He began to do a lot of research on our tax system and what dictated it. That's when his real trouble with the Revenue Canada Gestapo started.

According to Medd Income Tax is illegal. He says there is no law in Canada that says you must file income tax returns, and that the Federal Government has illegally encroached upon Provincial Taxation jurisdiction. He feels this is because both levels of government either don't know what the BNA Act says, or if they do they are ignoring it. "The Constitution is the highest law of the land. It is how this nation is to be governed. So why doesn't our government follow the rules? Why does the government of this country not govern according to this law", asks Medd?

Medd continues, "Revenue Canada, like any other government agency, is supposed to be working for the citizens of Canada. I don't know about you, but my dealings with them lately certainly don't give me any encouragement to believe this. They appear to be a law unto themselves, operating totally as they see fit, for their own benefit. It is obvious those who work for Revenue Canada for the most part, have never owned a small business. They have no idea of the real world."

As Medd became more and more aware of what Revenue Canada was all about, he became more and more adamant about not filing taxes. According to him Revenue Canada is no more than a sophisticated collection agency for the Bank of Canada which in turn reports individual Canadian taxpayers to the Bank of International Settlements based in Switzerland.

Hard ball began in 1991 after Medd had been fighting with Revenue Canada for eight years. In 1991 he was audited. After the audit Revenue Canada disputed some of Medd's expenses. This battle continued for five years. In 1996 the governments ordered Medd to appear at the Tax Court of Canada in Belleville, Ontario to resolve the difficulties. He did not appear and denied Revenue Canada jurisdiction over him, by resigning as a taxpayer. For the next three years life was peaceful.

This all changed however, when Medd began to assist others in the area who were having their problems with the Peterborough Tax Office. It wasn't long before Revenue Canada had their knickers in a twist over that. As more and more people began resigning as tax payers Revenue Canada became alarmed. He also gave Revenue Canada 30 days to pay up. So far, Medd says he hasn't received his money from them, but then he hasn't paid what they are suggesting he owes them.

Next step. Revenue Canada has now subpoenaed Medd to appear at the Lindsay Court House, 440 Kent Street West on March 22nd, 1999 at 9:30 AM. Medd has waived his jurisdictional denial as he now thinks it is time to bring this out into the open. I don't know what David has prepared for Goliath, however, Medd is not a fool, nor is he some kind of far out radical. He, along with many thousands of other Canadians believe that the tax imposed on us by our government is illegal. More and more Canadians every year do what Medd has done, refuse to file on legal grounds. Most, apparently, don't hear much from Revenue Canada and perhaps Medd wouldn't have either .... had he not chosen to help others. He suggests the Peterborough Revenue Canada Office alone is currently trying to collect approximately $40 million in outstanding taxes.

Medd is different than most folks, in that he doesn't care if everyone knows about his problems with Revenue Canada. As he says most people like to keep quiet if they have a tax problem and perhaps this is one of the reasons Revenue Canada can get away with some of the tactics they use. One of Medd's clients woke up one morning with a little guy in a suit taking the license plate numbers of all the vehicles in his drive, noting numbers on the equipment etc. The next thing he knew the suit walked into the house and started noting all his possessions. When asked who he was he stated he was from Revenue Canada and that Revenue Canada was going to attach his possessions. That's when he called Medd. Well ... the gentlemen still has his possessions, and hopefully with Medd in the arena wrestling with the feds on his behalf he will be able to keep them.

My guess is the court appearance of Brad Medd in Lindsay on March 22nd, 1999 will be well worth the trip. Medd is hoping for a large audience, he'd like everyone to know the truth about our illegal tax system. So .... if you are one of the millions who just hate paying those federal guys their big salaries and expense accounts you really should be in Lindsay on March 22nd, 1999. My guess is we'll probably be amazed at what we see and hear?

Revenue Canada began to pursue the Medd case again. After Medd having come through audits, orders to appear, disputing expenses and failure to file, the Gestapo have now decided to proceed again against Medd. The original expenses that Revenue Canada disputed were four figures, now after several years Revenue Canada has converted this into five figures. That upset Medd just a little and he invoiced the government for $500,000. Which was, he felt a conservative figure, for the illegal taxes he had paid them over the years.

More than 30 people showed up at the Lindsay Courthouse on Monday, March 21st1999. This number of supporters certainly surprised the judge. After some court procedures the case was re-scheduled for Thursday, May 6th at 9:30 AM. Brad was back in court in mid-September 1999 and again in mid-December when he was finally convicted of "failing to file an income tax return" and fined $9000 or 180 days in jail. He has since filed an Appeal with the support of a very competent lawyer, Michael Swinwood. Michael understands the "just-us" system and he is also fully aware of the "illegality" and "unlawfulness" of the Income Tax Act. Brad Medd's Appeal was filed on October 27th, 2000 at the Lindsay Ontario Courthouse. Brad's day in court will be sometime in the summer of 2001.
